BUT WHEN ARE PROMOTIONS FROM SUPERINTENDENT CADRE TO AC CADRE GOING TO BE GIVEN. IT HAS BEEN AGES SINCE WE HAVE SEEN A PROMOTION ORDER FROM SUPDT CADRE TO AC CADRE IN CBEC. AND IN THE MEANTIME OFFICERS ARE RETIRING AS SUPDTS ONLY, AFTER PUTTING IN A SERVICE OF 35 TO 38 YEARS WITH SINGLE PROMOTION IN THEIR CHEQUERED CAREER OUT WHICH 18 TO 20 YEARS AS SUPDT,   EVEN THOUGH THEY ARE ELIGIBLE TO BE PROMOTED AS AC.

At present the appeals of tax payers located in Andhra Pradesh are heard by CESTAT Bench located in Bangalore resulting in inconvenience not only to assessees but also to the lawyers who have to travel all the way to Bangalore. Almost 45 per cent of litigation pending in Bangalore Bench pertains to AP as it is hub of STP, SEZ & EOUs.

Andhra Pradesh’s Information Technology and Communications Minister Ponnala Lakshmaiah has written a communication to Union Finance Minister Pranab Mukherjee in this regard.

Setting up a full- fledged Bench of CESTAT in Hyderabad may take even 2 years as the Members and office staff for the Bench will be required to be hired by the Government and the recruitment process itself takes almost 2 years. Government  has not been able to fill even the existing vacancies of Members in existing Benches even after selection of some new Technical Members by the Selection Committee . The interviews for the post of new Judicial Members have already been completed. Even the Members posted in Bangalore Bench are due to retire shortly and it may also stop functioning.

AIT suggests that a Circuit Bench of CESTAT may be constituted immediately which may sit for 2 months in Hyderabad. If there is shortage of Members; retired President/Members of CESTAT can be hired on contract basis as most of the retired Members and even retired President are interested in coming back to CESTAT. A Retired President of CESTAT has even filed a petition in High Court for appointing him as a Member in CESTAT. They can also be engaged for visiting Hyderabad for searching suitable location for Circuit Bench as several visits are required for finalising the location.

                Hyderabad International Airport has a sanctioned strength of 60 Inspectors out of which 75% has to be filled up through Hyderabad CCA strength and the remaining 25% from outside. At present only 30 Inspectors are working with a vacancy of 30 Inspectors which is alarming and disurbing to run such an ever growing Airport. International flights have also commenced from Vizag Airport. In the recent past very few officers have applied for selection in Hyderabad Airport thus forcing the administration to run Customs work with such a huge deficit in working strength.

               Out of 30 working strength in Inspector cadre in Airport, atleast 10 officers have completed their tenure and are on extended term. To fill up the vacancies on a temporary/priority basis administration is likely to post five to ten officers from the present DR quota. Allotment in Hyderabad Zone to around 40 DR Inspectors who have completed their training is likely to be given and out of them around five to ten officers are likely to be posted to Airport.

             Since the response to calling for applications/willinginess for selection and posting in Aipport is poor, administrtation has decided to allot more number of Inspectors to Hyderabad-II Commissionerate in this AGT and out of the working strength of Hyderabad-II Comm'te, Inspectors will be posted to the Aiprort on transfer basis. Hereafter no willingness to work in the Airport will be called for and officers from Hyderabad-II Comm'te only will be posted to the Airport on transfer basis after arriving at some modalities/criteria for such transfers.

           This is a stop-gap arrangment till Cadre Restructuring takes place  after which a comprehensive policy for postings to the entire Customs postings i.e. Airport, ICD, Air Cargo etc. will be evolved.

II. MACP-I and II Orders:

     Vigilance clearance along with seniority confirmation has not yet  been received from all the Commissionerates of Hyderabad and Vizag Zone despite several reminders by way of DO letters issued by Commissioner-II for issuance of MACP-I and MACP-II orders for the period ending September,2012. Yesterday we have met and requested the administration to expedite these orders as some of the MACP-II eligible officers who will be granted GP-5400 and thus become entitled for travel through Airllines have already made arrangements for all India LTC  in this month. Non-granting of MACP-II in time to these officers will force them to travel through traines except in cases of North East/J&K tours.

III. Review of IZT/ICT Transfer Policy:

     The present IZT/ICT Transfer Policy for Inspector Cadre which was framed  in the year 2008 is due for review in the year 2013. Chief Commisisoner, Hyderabad, it is learnt, would like to review and evolve a new policy well in advance in this year itself for effecting it from 2013 AGT. After receipt of letter from the administration for our views/opinion, we will be calling for a General Body meeting  of our cadre to elicit views/susggestions of the cadre before we can submit our views/suggestions to the administration.  However, it is preferable to evolve a new transfer policy after CR is implemented.

Cut off date for completion of four years in a Commissionerate has not yet been decided and it is likely to be either 1st or 30th June.

Commissionerate-wise postings orders to Direct Recruit Inspectors  numbering around 40 who have been allotted to Hyderabad Zone will be issued today or tomorrow.

     Committee of Commissioners Meeting for ICT/Mofussil transfers of Inspectors within Hyderabad Zone is being held today 3.30 pm in HQRS Office. It is learnt that ICT/Moffussil transfers will be issued by next week.

2. IZT transfers:

       COC meeting for IZT transfers of Inspectors from Vizag Zone to Hyderrabad Zone has already been completed. It is learnt that only four applications of  Inspectors from Vizag Zone to Hyderabad have been cleared in the COC meeting. IZT orders are expected by this Friday.

Twenty Three officers in open, one officer each in SC and ST quota  have been promoted along with regularisation of previous ad-hoc officers.

        This practise of getting approval, which has been discontinued of late, of the nominated member/s of Vizag Zone has been revived with this DPC. Anyway all is well that ends well. Once this process of DPC is completed and yearly plan is drawn, promotions against retirement or consequential vacancies can be issued on a monthly basis henceforth till February,2013.

Sub: Central Government Employees Group Insurance Scheme-1980 – Tables of Benefits for the savings fund for the period from 01.01.2012 to 31.12.2012.

The undersigned is dirccted to refer to this Ministry’s O.M. No.7(I)/EV/2010 dated 31st January, 2011 forwarding therewith Tables of Benefits under CGEGIS for the year 2011. New Tables of Benefits for the savings fund of the Scheme based on a subscription of Rs.10 per month from 1.1.1982 to 31.12.1989 and Rs.15 per month w.e.f. 1.1.1990 onwards have been prepared for the year 2012 and a copy of the table is enclosed. Another Table of Benefits for the savings fund based on a subscription of Rs.10 per month for those employees who had opted out of the revised rates of subscription w.e.f. 1.1.1990 have also been drawn up for the year 2012 and a copy of that table is also enclosed. The amounts in the Tables have been worked out on the basis of interest @ 10 per annum(compounded quarterly) for the period from 1.1.1982 to 31.12.1982, 11% per annum(compoundcd quarterly) w.e.f. 1.1.1983 to 31.12.1986, 12% per annum(compounded quarterly) w.e.f. 1.1.1987 to 31.12.2000, 11% per annum (compounded quarterly) w.e.f. 1.1.2001 to 31.12.2001, 9.5% per annum(compounded quarterly) w.e.f. 1.I.2002 to 31.12.2002, 9.0% per annum(compoundcd quarterly) w.e.f.1.1.2003 to 31.12.2003. 8% per annum (compounded quarterly) w.e.f. 1.1.2004 to 30.11.2011 and 8.6% per annum (compounded quarterly) w.e.f. 1.12.2011 onwards. The mortality rate under the Scheme has been taken as 3.75 per thousand per annum up to 31.12.1987 and 3.60 per thousand per annum thereafter in both the cases. While calculating the amount it has beenassumed that the subscription has been recovered or will be recovered from the salary of the month in which a member ceases to be in service failing which it should be deducted from accumulated amounts payable.

It cannot be guessed whether the proposed arbitration will result in delay in implementation of CR. The reports of implementation of CR in three phases have not yet been confirmed by any one.

However, SG has confirmed that they are awaiting the presentation from the Member(P&V) on the CR proposals cleared by DoPT.  Once the presentation takes place the exact number of posts cadre wise will be known.

In the meantime Superintendents and Inspectors Association of Hyderabad Zone are planning to meet the Member(P&V) in Hyderabad on 27-4-2012 for submitting a joint memorandum on implementation of CR in Hyderabad Zone.

        GSTN SPV will be incorporated as a Section 25 (not-for-profit), non-Government, private limited company in which the Government will retain strategic control. It would have an equity capital of Rs. 10 crore, with the Centre and States having equal stakes of 24.5% each. Non Government institutions would hold 51% equity. No single institution would hold more that 10% equity, with the possibility of one private institution holding a maximum of 21% equity.

        GTSN SPV would have a self-sustaining revenue model, based on levy of user charges on tax payers and tax authorities availing its services. While the SPV`s services would be critical to actual rollout of GST at a future date, it is also expected to render valuable services to the CBDT, CBEC, State Government VAT Departments prior to the GST implementation.

          Since the proposed SPV will be a non-Government Private Limited Company; it will also be liable to pay Service Tax on services provided to Tax Administrations and tax payers as the service is not covered within the ambit of negative list of services. Had it been a wholly owned by the Government; the service provided by it would have been within the scope of  the negative list. Whether first GST Number will be allocated to GSTN SPV is to be seen but it would be an interesting case of service tax department itself paying service tax to SPV. This is the first fall out of the negative list of services. Not only the tax-payers will be taxed more but also the cash rich excise and service tax department will have to shell out service tax

CUSTOMS and Central Excise officers all over the country are exhilarated with the news that cadre review is cleared by DOPT and is on its way up – promotions are near to reality. But are they?

DDT 1488 – 16.11.2010, that is 17 months back, discussed the issue and said, Anyway the officers have enough material to discuss about in the next couple of years !! They can continue to discuss.

We are informed by reliable sources that CBEC and DOPT have not agreed on the number of posts and so they have decided to refer the matter to a Committee of Secretaries. So, the proposals from both CBEC and DOPT will go to the CoS and the Committee will perhaps hear all sides and do arbitration. It is understood that the DOPT has slashed the numbers proposed by the CBEC. CBEC wanted more than 3500 posts of Assistant Commissioner/Deputy Commissioner and what DOPT has conceded is around 2000. They wanted 18 posts of Principal Chief Commissioner in the super scale of Rs. 80000/-; they got 11. They wanted about 170 new Commissioner posts; they are getting 45.

Officers can continue to discuss for some more time!

In the meanwhile, it is learnt that the CBEC is going ahead with the promotion to the posts of Commissioners and Assistant Commissioners, as per the existing seniority lists – the Supreme Court order does not seem to have any impact at least in the immediate promotions. At least some officers can hopefully get that elusive promotion.

Minister of State for Finance Palanimanickam, said yesterday in Tiruchi that both the Income Tax and Central Excise departments have been facing shortage of manpower. He said that steps are being taken for granting promotions to the Staff.
